ARBİTRATİON CUSTOMER ARBITRATION COMMITTEE

The Dec Jul Arbitration Committee is a conciliation committee established by the Association of Participation Banks of Turkiye to assess and resolve disputes between individual customers of participation banks and these banks.

Who Can Apply?

Since the activities of the Arbitration Committee cover all types of individual banking transactions not related to commercial activities, only real persons can apply to the Arbitration Committee. Applications made by legal entities and applications of natural persons that do not have individual content are not accepted, commercial, agricultural,..etc. applications related to activities are not evaluated as individual content. Since the activities of the Arbitration Committee cover all types of individual banking transactions not related to commercial activities, only real persons can apply to the Arbitration Committee.

What Issues Can I Apply For?

The Arbitration Committee examines all kinds of retail banking transactions not related to commercial activities, current and participation accounts, personal loans, credit cards, ATM cards,..etc. examines complaints or disputes related to. Applications that have not reached the Union for transmission to the Delegation within sixty days following the bank's response date, Applications that have not reached the Union for transmission to the Delegation within two years from the date of the transaction or action subject to the application, Applications submitted to the Judiciary, Insurance Arbitration Commission or Consumer Arbitration Committees, Applications arising from banking transactions related to commercial, agricultural, etc. activities that do not have an individual nature, as well as applications made by legal entities, Applications about the personnel of banks or applications of a general nature about the products and services they offer, Applications related to decisions taken by a bank whose bankruptcy or liquidation has been decided, Applications related to acts prescribed as crimes in the Laws, Applications related to unrealized transactions, Applications that have previously been reviewed and decided by the Committee. Without prejudice to the right of objection of the applicant, applications that have been resolved between the applicant and the bank, applications related to credit policies of banks and credit evaluation, monitoring, risk management, applications related to transactions carried out by foreign branches of banks, applications related to consultancy requests, applications related to material and moral compensation claims are not examined by the Arbitration Committee.

At What Time Can I Apply?

If the answer provided by the Customer by the Bank's general directorate or the relevant branch is not sufficient, the application form must be filled out within sixty days from the date of the answer, and within sixty days from the end of this period, if the Bank does not respond within thirty days, within two years from the date of the transaction or action subject to the application, and applied to the Union for transmission to the Delegation. Applications that do not reach the Union within sixty days after the response date or the expiration of the response period of the bank's general directorate or the relevant branch, Applications that do not reach the Union within two years after the date of the transaction or action subject to the application, are outside the scope of the mission of the Delegation.

What Kind of Process Is Followed in the Applications?

According to the provisions of the relevant Communiqué, the application must be made in accordance with the process specified below.

1.Stage - Application to the Bank : Before applying to the Delegation, the customer must apply to the general directorate or the relevant branch of his bank in writing, via the website or by e-mail and receive a confirmation document from the bank stating that the application he has made has been notified, as specified in the Notification. In order for the application made to the delegation to be processed within the scope of the Communiqué, the above-mentioned application must necessarily be made before. Petitions sent to the Union will not be processed without an application to the bank.

2.Stage - Receiving the Bank's Response : The bank's response time is 20 days for applications related to credit and debit cards, and 30 days for applications related to other issues other than these. The bank may extend this period by 10 days provided that it notifies it within 30 days.

3.Stage - Application to the Delegation :

• When a response is received from the bank within the time limit: 2 above from the bank. when a written response is received within the period specified in the stage, the Individual Customer Arbitration Committee Application Form is filled out and sent to the Association of Participation Banks of Turkiye no later than 60 days from the date of the response.

• If a response is not received from the Bank within the time limit: If a response is not received from the Bank within the above-mentioned time period, the Individual Customer Arbitration Committee Application Form is filled out and sent to the Association of Participation Banks of Turkiye within 60 days after the expiration of this period. Since applications made without filling out the Application Form will be considered invalid, this Form must be used in the applications to be made to the Delegation.

What Should be Added to the Application Form?

After filling out the Application Form, the following documents must be added to the Form:


* A sample of the application petition sent to the bank,


• If there is, a sample of the application confirmation document,


* A sample of the written response received from the bank,


* Examples of documents related to the transactions subject to the application,


* Other document samples, if any.

Transfer of the Application to the Judiciary, Insurance Arbitration Commission or Consumer Problems Arbitration Committee After it is Submitted to the Committee

After its transmission to the delegation, the mission of the Delegation regarding the application submitted to the judiciary, the Insurance Arbitration Commission or the Consumer Arbitration Committee ends. The application submitted to the judiciary, the Insurance Arbitration Commission or the Consumer Arbitration Committee is notified to the Committee by the customer or the relevant bank. The examination of the applications by the Panel does not stop the legal time limitations related to the application to the court or arbitration by the parties or the transfer of the matter to the court or arbitration.
